Loula contracts: a clear and secure framework for worry-free car sharing

At Loula, our goal is to offer a secure car-sharing solution while giving co-sharers the freedom to organize their own arrangement.
To make this possible, three essential tools are used: the General Sharing Terms, the Specific Sharing Terms and the Vehicle Condition Report.
These documents provide a clear and protective framework, while adapting to the specific needs of each sharing agreement.
General Sharing Terms
First, whenever a sharing agreement takes place, both users must read and sign the General Sharing Terms.
This document sets out the rights and obligations of Loula users. These terms form the foundation of the rules designed to ensure a smooth and worry-free sharing experience.
They notably specify the process in case of a dispute or claim, the terms for taking possession of and returning the vehicle, as well as matters related to insurance and compensation.
The General Sharing Terms form the legal basis of the sharing agreement and must be respected by all owners and renters using Loula.
As their name suggests, these terms are general and therefore do not take into account the specific details of each sharing agreement. This is why they are supplemented by the
Specific Sharing Terms.
Specific Sharing Terms
In addition to the General Sharing Terms, a second document is used: the Specific Sharing Terms.
These are specific to each sharing agreement and are therefore unique. They define the key terms of the arrangement agreed upon by the owner and the renter.
They notably include:
the type of sharing chosen, including the number of days per week and the duration in months;
the agreed compensation;
the vehicle pick-up and return location;
the number of kilometres allowed per week or per month;
any restrictions, such as no smoking, pets not allowed, etc.
In short, all the details of the sharing agreement are included in these Specific Sharing Terms.
They must be drafted using the template provided by Loula and may include any additional terms agreed upon by the co-sharers.
These terms are established during the preliminary meeting, when both users meet. They must be signed by both parties and sent to Loula.
In the event of non-compliance with the Specific Sharing Terms, Loula may apply sanctions, which may include the definitive termination of the sharing agreement.
These terms were created to give Loula users full freedom in organizing their sharing agreement. Once approved, they reflect a mutual discussion and agreement between both parties. They may be modified later, subject to both parties’ approval.
Vehicle Condition Report
When the co-sharers meet, Loula requires a Vehicle Condition Report to be completed.
This document includes an evaluation grid, ranging from “Very good condition” to “Poor condition”, for each part of the vehicle, as well as instructions to take around twenty photos.
This report must be signed by both co-sharers and serves as the official reference for the condition of the vehicle at the start of the sharing agreement.
Any damage identified after this assessment will be attributed to the co-sharer responsible for the vehicle at the time of the incident.
